the Interior ES/CO: T&E/PMJM/Survey December 21, 1999 Ron Beane Dear Mr. Beane: Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered Species Act of 1973 (ESA), as amended (16 U.S.C. 1531 et seq.), the Service reviewed the Preble's meadow jumping mouse, Zapus hudsnoius preblet, (Preble's) survey report submitted with your letter of October 22, 1999. This report regards Jackson Creek Parkway and Baptist Road in El Paso County, Colorado (Section 36, Township 11 South, Range 67 West). Given your compliance with the Preble's survey guidelines, the Service finds the report acceptable and agrees that Preble's habitat is not present within the subject area. Thus, the Service concludes that development or other actions on this site should not directly affect the continued existence of Preble's provided that such development stays at least 300 feet from the 100-year floodplain of Jackson Creek. Outfalls from any on-site detention facilities also must not impact potential Preble's habitat. Since Preble's populations exist downstream from and near the site, actions on the site that result in significant modification of Preble's habitat downstream (for example, through alteration of existing flow regimes, or sedimentation) may be subject to provisions of the ESA. Specifically, there may be potential that runoff from the site may alter the hydrology and ultimately the geomorphology of Jackson Creek.
