TOWN OF MONUMENT ORDINANCE NO. 4-2000

An Emergency Ordinance Declaring a Three-Month Moratorium on All Development Applications including Plans, Plats, and Annexations

Whereas, the Town of Monument experienced a 33% residential growth rate in calendar year 1999, and

Whereas, a significant number of residential, commercial, and industrial projects are in the Town's planning process or about to be submitted as applications to the Town's planning process, and

Whereas, the newly constituted Board of Trustees elected on April 4,  2000 requires a sufficient amount of time to learn the Town's current planning process, assess it, and, if necessary, revise it to be able to cope with the growth in the near future.

Now therefore, be it ordained by the Board of Trustees of the Town of Monument, Colorado that:

Section 1: The Board of Trustees of the Town of Monument hereby declares a moratorium on all development applications, plans, plats and/or annexations before the Board of Trustees and Planning Commission for a period of three months (through July 17, 2000) to give the new Board of Trustees time to study, assess and possibly amend the Town's planning process.

Section 2: Emergency Clause. The Board of Trustees hereby finds, determines and declares that this Ordinance is necessary for the immediate preservation of the health, safety and welfare of the Town of Monument because time is of the essence in studying and amending the planning process.

Section 3: Safety Clause. The Board of Trustees hereby finds, determines and declares that this Ordinance is promulgated under the general police power of the Town of Monument, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The Town Board of Trustees further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained.

Section 4: Severability. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person of circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall  not affect application to other persons or circumstances.

Section 5: This Ordinace shall become effective upon adoption.
