March 23, 2000 Mayor Sibell, Trustees, Rick Sonnenburg, Manager, and James Folkestad,
Attorney On February 17th, a legal notice was published in the Tri-Lake Tribune announcing that on March 15th the Monument Planning Commission would consider the proposal for the Baptist Road Retail Center. Due to worsening weather, I called Town Hall on the afternoon of the 15th and was told that the meeting was canceled and had not yet been rescheduled. Many other people also called Town Hall and were told the same thing. Subsequently, the meeting was rescheduled to March 27th. It has been suggested that the meeting on the 27th is a continuance of the meeting scheduled for the 15th and therefore no further public notice is required. Since the meeting on the 15th was widely announced as canceled, the meeting on the 27th cannot possibly be a continuance of the meeting scheduled for the 15th. Even if a meeting of some sort was held on the 15th, many who have an interest in the matters to be discussed were not in attendance because they had been told by Town Hall staff that the meeting had been canceled. They would therefore not have heard the date, time, and location where the continuance was to be held. Consequently, the requirement for legal notification applies to the meeting on the 27th. Since at this point, it is not possible to provide adequate legal notice regarding the matters to be discussed on March 27th, the Coalition respectfully requests that the March 27th meeting be rescheduled until such time that proper notification can be accomplished. Thank you for your attention to this matter.
Sincerely, John Heiser on behalf of the members of cc: James Colvin, Attorney |
