Planned Unit Development Rezoning Justification Statement
To Gentlemen:
Matrix Design Group, Inc. is requesting the rezoning of property consisting of approximately 50.2 acres located South of Hay Creek Road to be known as Hay Creek Ranch. The property is currently zoned as a RR-3 Rural Residential District located within the Tri Lakes Master Plan Area. The new zoning requested for this property is a Planned Unit Development (PUD).
The El Paso County Land Development Code and Colorado State Statue establish the Planned Unit Development District for specific purposes. The following purposes apply to this site:
To provide for necessary recreational facilities conveniently located to residential housing;
To ensure that the provisions of the zoning laws and regulations promulgated there under which direct the uniform treatment of dwelling type, bulk, density, and open space within each zoning district will not be applied to the improvement of land by other than lot-by-lot development in a manner which would distort the objectives of the zoning law and regulations;
To encourage innovation in residential development and renewal so that the growing demands of the population may be met by greater variety in type, design and layout of building and by the conservation and more efficient use of open space ancillary to said buildings;
To provide more flexibility and latitude of design;
To provide more flexibility in the development review process;
To provide for a greater variety of principal and accessory uses in the development of land;
To lessen the burden of traffic on streets and highways;
To conserve the value of the land
To encourage innovative and creative developments of parks, recreation areas, and open space, and;
To encourage integrated planning in order to achieve the above purposes.
Request for rezoning of this property allows for the design of additional lots to serve the aesthetic, functional, and financial needs of the family owners who will occupy the majority of the newly proposed lots. The new PUD also allows for a single private street that alleviates the need for costly public maintenance, multiple driveway entries and thereby reducing congestion on Hay Creek Road. As previously mentioned, this property is approximately 50.2 acres. Under the RR-3 requirements, a maximum of 10 lots would be created. A PUT) zone allows the creation of fifteen lots ranging in size from approximately 3.04 acres to 4.29 acres. The end result would be five additional lots for residential purposes and significant preservation of aggregated open space for retention of the visual environment.
Hay Creek Ranch has been given confirmation of service in the 15-lot configuration from the following public services; Mountain View Electric Association, Qwest Communications, Glaser Gas, Inc., and Tri-Lakes Fire Protection District. The fire district can provide a response time of six to eight minutes. Each lot will be served by individual water wells and septic systems.
Transportation within this proposed development would be two-fold. Presently, Hay Creek Road (a 18-foot wide public right-of-way) runs along the North line of the property. Access through this development will be provided by a 22-foot wide private road that intersects with Hay Creek Road at two points. The road shall be constructed and maintained by the Hay Creek Ranch Home Owners Association (HOA).
Hay Creek Ranch has developed restrictive covenants and conditions to insure the integrity of the property and properties surrounding it. These conditions will be enforced by the HOA. Fees will be collected as part of the HOA By-Laws to fund operations and maintenance for trash collection, snow removal and road maintenance.
Rezoning of this property will be an asset to the community and will produce a higher quality of life, better public services, and an aesthetically pleasing architecture, that will be an asset not only to the future land owners, but also the Tri Lakes Area and El Paso County.
